Waca Warranty
Throughout this Extended ESC (“ESC”), the words “We,” “Us”, and “Our” refers to
AIG Warranty Services and Insurance Agency, Inc. (“AIGWS”) in those states that
AIGWS is the Provider (Obligor), and the Dealer in those states where the Dealer
is the Obligor of this ESC. The words “You” and “Your” refer to the Contract
Holder or the person to whom it was properly transferred.
Term and Coverage: The term of this ESC is from the date of purchase of the
eligible covered produc(s) to the end of the term purchased by You.
This ESC is inclusive of the manufacturer’s warranty; it does not replace the
manufacturer’s warranty, but provides certain additional benefits during the
term of the manufacturer’s warranty. After the manufacturer’s warranty expires,
this ESC continues to provide the manufacturer’s benefits as well as certain
additional benefits listed within this ESC.
1. IF YOUR PRODUCT REQUIRES SERVICE: To arrange for repair service, call
866-822-9789. Repair service will be available during regular
business hours, Monday through Friday, and will be provided by a manufacturer
authorized service center or someone we designate. All ESC coverage is
applicable only to items, costs and time periods not covered by the express
manufacturer warranty regardless of whether the manufacturer is out of business.
AT OUR OPTION, REPLACEMENT PARTS WILL BE NEW, REMANUFACTURED, OR NON-ORIGINAL
MANUFACTURER’S PARTS THAT PERFORM TO THE FACTORY SPECIFICATIONS OF THE ORIGINAL
PRODUCT. If We determine that Your covered product cannot be repaired, We will
replace it with a new or remanufactured product of like kind, quality and
functionality. Technological advances may result in a replacement product with a
lower selling price than the original product. Once the covered product is
replaced, this contract is considered fulfilled.
On-Site Repair: If You purchased an ESC that provides On-Site service, please
note the following:
You must provide a safe, non-threatening environment for our technicians in
order to receive service.
In some cases, You may be required to ship Your covered product for repair. We
will pay the shipping charges.
Same Day On-Site or 24 Hour On-Site: If You purchased an ESC which offers either
Same Day On-Site Service or 24 Hour On-Site Service, please note the following:
• On-Site service cannot be scheduled until repair parts are delivered to the
repair location.
• Once it has been confirmed that the required parts are at the repair site, You
will be contacted by the repair technician to establish an appointment time.
• All attempts will be made to establish appointment times as follows:
A. Same Day Service – If the parts confirmation occurs before noon (12pm) of
that business day, every attempt will be made to get a technician to the repair
location before 5pm of the same business day. If a technician cannot perform the
repair before 5pm of the date of request, a technician will be at the repair
site by noon of the next business day following the day of the original request.
If the parts confirmation occurs after noon (12pm) of that business day, a
technician will be dispatched to perform the repair before noon (12pm) of the
next business day following the day of request.
B. 24 Hour Service – If the parts confirmation occurs before noon (12pm) of that
business day, a technician will be dispatched to the repair location before noon
(12pm) of the next business day.
If the parts confirmation occurs after noon (12pm) of that business day, a
technician will be dispatched to perform the repair before 5pm of the next
business day following the day of request.
Laptop Coverage - Coverage includes 3-Way shipping and providing a shipping
container to and from a depot servicer of our choice. All shipping costs are
covered under the ESC.
Depot Service: Some products must be shipped to a service location for repair
(e.g. camcorders, cameras, etc.). If Your ESC has Depot Service, we will pay the
shipping charges to and from the designated service location.
Replacement Plans: If You have purchased a Product Replacement Plan, Your
product will be replaced, not repaired.
Call 866-822-9789. You will be required to ship Your product, at
Your expense, to a designated location for inspection. If Your product qualifies
for replacement, You will receive one of the following: A new or remanufactured
product of like kind, quality and functionality; a gift certificate equal to the
original purchase price of the product excluding shipping, handling and taxes; a
Merchandise Replacement Voucher equal to the original purchase price of the
product excluding, shipping, handling and taxes; or a check for the original
purchase price of the product excluding shipping, handling and taxes. Once the
replacement process has been completed, this contract is consider fulfilled. If
Your product is found to be non-defective, it will be returned to You.
2. Additional Coverages: Power Surge Protection: This ESC provides power surge
protection in excess of any other insurance coverage, from the date of purchase
of this ESC. WaCA Performance Guarantee: Subject to parts availability and
covered product accessibility, if We do not make the scheduled service call
within the specified timeframes, upon the customer’s request, the ConsumerCare
ESC will be extended for an additional one month term. Call
866-822-9789 to request the extension. While We try to complete
service as quickly as possible, We are not responsible for delays caused by
factors beyond Our control, including, but not limited to, manufacturer’s
delays, unavailability of replacement parts, or Acts of God. No Lemon Guarantee:
Following the expiration of the manufacturer’s warranty term and after three
service repairs have been completed on an individual product within a twelve
month period, and that individual product requires a fourth repair, as
determined by Us, We will replace it with a product of comparable performance,
not to exceed the original retail purchase price. Technical advances may result
in a replacement product with a lower retail price than the original product.
The original product and purchase receipts must be returned to Us, along with
three separate service repair receipts from separate service repair incidents,
all authorized by Us, in order to qualify. One service authorization number is
the equivalent of one repair. Keep Your service receipts. Copies of service
receipts cannot be provided by Us. Preventive maintenance checks, cleanings,
product diagnosis, customer education, accessory repairs or replacements, and
computer software related problems are not considered repairs for the purposes
of this No Lemon Guarantee. Once the product is replaced or cash settled at
current market value, the ESC for that item is considered fulfilled.
3. ESC Limits of Liability: Aggregate Limit: The total payment(s) for all claims
under this ESC shall not exceed the original retail purchase price of the
covered product or system, except in those cases in which the No Lemon Guarantee
applies.
4. Purchase Receipts and Service Records: This ESC and all original receipts may
be required for any service or product replacements or exchanges. Please keep
them in a safe place.
5. Exclusions - What Is Not Covered: This ESC Does Not Cover:
(a) This ESC does not cover any malfunction, defect, breakdown, or disruption of
any product functions or the function of any related component or software
arising from any design flaw caused by or arising from or related to, directly
or indirectly, any design, planning or engineering incompatibility, omission, or
deficiency with the incidence of any date.
(b) Loss or damage caused by accidental or intentional physical damage, spilled
liquids, insect infestation, misuse, abuse, or service costs or damage caused by
unauthorized repair personnel.
(c) Replacement costs for lost or consumable parts (knobs, remote control
devices, cartridges, drums, batteries, etc.), problems due to improper and/or
unauthorized installation or repairs, and cosmetic damage (such as cracked cases
and broken hinges) or defects that do not inhibit the proper operation and
performance of covered items.
(d) Products provided for public use or rental. Use of a product for these
purposes will void this ESC.
(e) Loss or damage to stored data; repairs related to software, computer
viruses, display markings caused by video games or computer programs, or
computer hardware that is added after the original purchase.
(f) Special, indirect, consequential, or incidental damages.
(g) “No problem found” diagnosis.
(h) Failure resulting from normal wear and tear.
(i) The ESC provides pixel repair based upon manufacturer’s guidelines.
(j) We are not responsible for personal items left in the product to be
repaired.
(k) This ESC excludes products that are not listed on the ESC.
(l) The ESC is fulfilled when a product is replaced after the expiration of the
manufacturer’s warranty.
6. ESC Holder’s Responsibilities: We strongly recommend (but do not require as a
condition of this Contract) the regular back up of data and software. This
contract does not cover the cost of data recovery or other consequential or
incidental damages.
7. Renewal: If a renewal contract is offered by Us, the contract price quoted
will reflect the age of the product and current service costs at the time of
renewal.
8. Transfer: This ESC may be transferred to an eligible party to whom You sell
or give the equipment while this ESC is in force. You must notify the
Administrator in writing of the name and address of the new owner within 15 days
of the change of ownership. Proof of ownership will be required as part of the
transfer documentation.
9. Cancellation: You may cancel this ESC for any reason at any time. To cancel
it, submit your request to cancel in writing to the Administrator. If you cancel
within 30 days of receipt of your ESC and We have not paid a repair claim, you
will receive a full refund. This right to void the ESC is not transferable and
applies only to the original ESC purchaser. If you cancel after 30 days or at
anytime after we pay a claim, you will receive a pro rata refund of the Contract
Price based on the days remaining less a cancellation fee of $25.00 or 10% of
the ESC price (whichever is less).
We will not cancel this ESC except for: a) fraud, b) material misrepresentation,
c) non-payment of the ESC price, d) violation of any of the terms and conditions
of this Contract which occurs after the effective date and which materially and
substantially increases the service required, e) or if required to do so by any
regulatory authority. Notice of Our cancellation will be in writing and
delivered to You at your address at least 30 days prior to cancellation If We
cancel this ESC, Your refund will be based on 100% of the unearned pro rata ESC
price.
10. Insured ESC: This ESC is insured by New Hampshire Insurance Company, This
ESC is secured by a contractual liability insurance policy provided by New
Hampshire Insurance Company, 175 Water Street, 20th Floor, New York, NY 10038.
Telephone number (800) 250-3819. If You fail to receive a cancellation refund,
claim payment or service within 60 days of submitting the request, You may
submit the claim directly to the insurance company.
11. ESC Provider (Obligor) & State Variations: Warranty Corporation of America
(“WaCA”) is the Administrator under this plan. AIGWS is the obligor and provider
under this plan, except in California, Oklahoma and Wisconsin. AIGWS can be
contacted at: 500 West Madison Street, Chicago, IL 60661. Telephone number (800)
332-4800. The Dealer is considered the Obligor only in those states which
require the Dealer to be the obligor.
If You reside in one of the following states, these provisions apply to You:
Alaska: The Dealer is the Obligor under this ESC.
Arizona: If Your written notice of cancellation is received prior to the
expiration date, the Administrator shall refund the remaining pro-rata price,
regardless of prior services rendered under the ESC.
California: AIG Warranty Guard, Inc. (AIGWG) is the Obligor under this ESC. AIG
Warranty Guard, Inc. (AIGWG) and AIG Warranty Services and Insurance Agency,
Inc. (AIGWS) can be contacted at 500 Madison St., Chicago, IL 60661.
Connecticut: The expiration date of this ESC shall automatically be extended by
the duration that the product is in our custody while being repaired. In the
event of a dispute with the Administrator, you may contact The State of
Connecticut, Insurance Department, PO Box 816, Hartford, CT 06142-0816, Attn:
Consumer Affairs. The written complaint must contain a description of the
dispute, the purchase price of the product, the cost of repair of the product
and a copy of the ESC.
Georgia: Cancellation will comply with Section 33-24-44 of the Georgia code.
Kansas: This ESC is not an insurance policy.
Nevada: If you cancel this ESC, no deduction shall be made from the refund for
the cost of any service received.
North Carolina: The purchase of this ESC is not required either to purchase or
to obtain financing for a home appliance.
Oklahoma: The Dealer is the Obligor under this ESC. This Contract is not issued
by the manufacturer or wholesale company marketing the product covered by this
ESC. This ESC will not be honored by such manufacturer or wholesale company. If
either You or we cancel this ESC, the return of the ESC price will be based upon
one hundred (100) percent of the unearned pro rata price of the ESC, less the
cost of any service received.
South Carolina: To prevent any further damage, refer to the owner’s manual. In
the event the ESC provider does not provide covered service within sixty (60)
days of proof of loss by the contract holder, the contract holder is entitled to
apply directly to the New Hampshire Insurance Company. If the insurance company
does not resolve such matters within sixty (60) days of proof of loss, they may
contact the South Carolina Department of Insurance at PO Box 100105, Columbia,
South Carolina 29202, telephone number (800) 768-3467.
Utah: Coverage afforded under this Contract is not guaranteed by the Utah
Property and Casualty Guarantee Association.
Wisconsin: This ESC is subject to limited regulation by the Wisconsin Office of
the Commissioner of Insurance. This ESC shall not be cancelled due to
unauthorized repair of the covered equipment. If you cancel this ESC, no
deduction shall be made from the refund for the cost of any service received.
This ESC is backed by a contractual liability policy with limits of liability of
$5000 per claim and $25,000 in aggregate per plan. Warranty Corporation of
America is the Obligor under this ESC.

Halliker’s, Inc. dba Traders World warrants its line of Sonata Trading Computers
to be free from defects in material and workshop for a specific warranted period
as stated below from the date of original purchase from Halliker’s, Inc. This
warranty is contingent upon proper use of the product in question and does not
cover products which have been modified or which have been subject to unusual
physical or electronic stress. Warranty for third party hardware, software and
any special items are subject to the third party’s warranty policy.
Because the parts in our computers are the highest quality, it is very rare that
they fail. In case they do, it is then wise to have the warranty below for parts
replacements. The cost of the warranty is generally $60.00 a year.
Warranty takes over from Warranty Corp of American basically from the date it is
shipped. You will receive hardware technical support from us for the first 30
days. After the first 30 days you will then receive hardware technical support
and onsite warranty from the terms you purchased on your order from Warranty
Corp of America. Call them at 877-FIXESIT (349-3748). They will determine on the
phone what part in your computer has failed. When it is determined, the part is
then shipped out by D&H to the technician in your area. The technician will
contact you and install the part on your computer.
Warranty and any service of monitors and keyboard and the mouse is not covered
by Warranty Corp of America but by the manufacturer.
Exclusion of Certain Computer-Related Losses.
Halliker’s Inc. dba Traders World is not responsible and will not pay for loss
(“loss”) or damage caused directly or indirectly by the following. Such loss
(“loss”) or damage is excluded regardless of any other cause or even that
contributes concurrently or in any sequence to the loss (“loss”) or damage.
1.The failure, malfunction or inadequacy of:
a. Any of the following, whether belonging to any insured or to others:
(1) Computer hardware, including microprocessors;
(2) Computer application software;
(3) Computer operating systems and related software:
(4) Computer networks:
(5) Microprocessors (computer chips) not part of any computer system; or
(6) Any other computerized or electronic equipment components; or
b. Any other products, and any services, data or functions that directly or
indirectly use or rely upon, in any manner, any of the items listed in Paragraph
A.1.a or this document due to the inability to correctly recognize, process,
distinguish, interpret or accept one or more dates or times. An example is the
inability of computer software to recognize the year 2000.
2.Any advise, consultation, design, evaluation, inspection, installation,
maintenance, repair, replacement or supervision provided or done by you or for
you to determine, rectify or test for, any potential or actual problems
described in Paragraph A.1. of this document.
You can return the computer for a refund within 21 days after your receipt of
the computer if you disagree with the trading computer warranty and the
exclusion of certain computer-related losses. By keeping the computer beyond the
21 days you are accepting these terms.
REGISTER WITH MICROSOFT
Your Sonata Computer will ask you to register with Microsoft through the
internet or by phone within 30-days after we configured it. Please do it asap or
your computer will stop working.
We
warranty the Sonata Trading Computer against defects in the
materials or workmanship for a period of 1 year from the
date of shipping printed on your invoice. As you see above
you may purchase additional warranty through PCPinpoint and
Warranty Corp of American through us. This coverage is
between you and the warranty companies.
